Brevard woman eats marijuana in back of patrol car

A Brevard court clerk crashed a car and ate the marijuana police found in her possession, according to Florida Highway Patrol.

Police say Tavish Kay Smith, 33, crashed a red pickup truck into another car on June 13, causing the truck to lose a tire. She drove on, later crashing into a ditch along U.S. 1 near Olsen Road in Cocoa.

When Smith spoke, an FHP trooper could smell alcohol coming from her breath, her eyes were bloodshot and glassy and her eyelids were droopy, according to a report.

The trooper reported she had a hard time getting out of the truck. After police read her rights, she declined to speak, do field sobriety exercises or take a breath test.

Police arrested her and searched her car. The trooper found a bag that looked like it held 12 grams of marijuana. Police put her in a patrol car. She asked for her flip flops, which were still in the truck. The trooper went to get them, and while he was gone, she slipped her left hand out of her handcuffs and grabbed the marijuana from the center console, according to the police report. She ate most of the marijuana before placing the bag back where it was.

The trooper came back and found about one gram left in the bag.

Smith scratched her nose, alerting the trooper that she had slipped out of her handcuffs. He removed her from the car, handcuffed her again and found marijuana crumbs around the back seat. She also had crumbs on her hands.

Smith told police she didn't eat the pot. Video from the car reportedly shows Smith eating it.

Police took her to Wuesthoff Hospital to be cleared, then to jail.

Court records show she was booked on charges of tampering with evidence, possession of marijuana, driving under the influence, leaving the scene of an accident, possession of drug paraphernalia and resisting an officer without violence.
